The Commission proposes to add section to this part to carry out the mandate of section 205. This proposal is intended to implement the clear Congressional directive to combat the deceptive marketing of “free credit reports” through “prominent” disclosures. In enacting section 205, Congress was well aware of current practices in this area, as well as the Commission’s efforts to address them in the settlements. As explained more 16 fully below, it is clear that Congress sought a marked and substantial change from the status quo, requiring more significant disclosures than any currently required or used in advertisements for “free credit.
