International Record Syndicate, Inc., the court enforced a liquidated damages clause in a contract. In this case, the decision was easy since a provision in the contract stated: “[r]eimbursement for loss or damage shall be determined by a photograph’s reasonable value which shall be no less than $1,500 per transparency.” The court stated: “The evidence clearly shows that photographs are unique items with many factors bearing on their actual value.
