On August 27 2004 the Workers Compensation Court held that Stavenjord is retroactive to June 3 1999 the date of the Henry decision . The Court held that a common fund was created for claimants reaching Maximum Medical Improvement on or after June 3 1999. The decision was appealed to the Montana Supreme Court. The Montana Supreme Court issued their decision on the appeal on October 6 2006 and modified the lower court decision holding that a common fund was not created. The court also held that the decision applies retroactively to claims from July 1 1987. The cost to retroactively pay claims to July 1 1987 is estimated at million dollars for the Montana State Fund New Fund- for claims on or after July 1 1990 .
